The deposit when reserving a car: what each side signs without knowing

A deposit isn’t a gesture — it’s a contract. What happens if you back out, what happens if the seller does, and how to put it in writing.

The deposit is the amount the buyer hands over to reserve the car while the deal is completed. It looks like a minor step and is a miniature contract — deposit disputes fill small-claims courts.

What the law says if you agree nothing

Without an express pact, the payment is normally read as part of the price: an advance. If the deal collapses, the argument starts about who breached and what gets returned.

Penitential arras: the clear formula

If the document expressly says the amount is delivered as penitential arras, the game is defined: if the buyer withdraws, they lose it; if the seller withdraws, they return it doubled. It gives both sides an exit at a known price.

What the deposit receipt must say

Identification of the parties and the car, total agreed price, amount delivered and in what concept, deadline to complete the purchase, and exactly what happens if either side pulls out. Two signatures.
